Terms of Service

These Terms of Service ("Terms") govern your access to and use of BotInbox ("we", "us", "our") and its related services, including the website at botinbox.com, APIs, and applications (collectively, the "Service"). Please read these Terms carefully before using the Service.
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you must not use the Service.
2. Description of Service
BotInbox is an omnichannel customer communication platform that provides a unified inbox for email, WhatsApp, live chat, and other messaging channels. The Service includes AI-powered features, automation tools, analytics, team collaboration capabilities, and a REST API.
3. Account Registration and Security
You must provide accurate, current, and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@botinbox.com of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your credentials.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited messages (spam), phishing attempts, or deceptive content.
- Distribute malware, viruses, or any harmful code.
- Violate any applicable local, national, or international laws or regulations.
- Infringe upon intellectual property rights of any third party.
- Harass, threaten, or abuse other users or their end-users.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Interfere with or disrupt the integrity or performance of the Service.
- Use the Service for any illegal, fraudulent, or unauthorized purpose.
We reserve the right to suspend or terminate accounts that violate these terms, with notice where practicable.
5. Your Data and Intellectual Property
You retain all rights, title, and interest in your data. We do not claim ownership of any content you upload, create, or transmit through the Service. You grant us a limited, non-exclusive, worldwide license to use, process, and store your data solely for the purpose of providing and improving the Service.
We will not access your data except as necessary to provide the Service, respond to support requests, or comply with legal obligations. Our data handling practices are described in our Privacy Policy.
6. Data Processing Agreement
Where you use the Service to process personal data of your end-users, you are the data controller and we are the data processor under the GDPR. Our standard Data Processing Agreement (DPA) is incorporated into these Terms and is available upon request. The DPA includes Standard Contractual Clauses for international data transfers where applicable.
7. Payment and Billing
- Paid plans are billed in advance on a monthly or annual basis.
- All fees are exclusive of applicable taxes unless stated otherwise.
- You agree to pay all fees associated with your selected plan.
- We may change pricing with at least 30 days' written notice. Price changes will apply to the next billing cycle.
- The free tier is available with usage limitations as described on our pricing page.
- Refunds may be issued at our discretion for annual plans within the first 14 days.
8. Service Availability and SLA
We strive to maintain 99.9% uptime for the Service. We may perform scheduled maintenance with at least 24 hours' advance notice via email or in-app notification. We are not liable for downtime or service interruptions caused by factors outside our reasonable control, including force majeure events, third-party service outages, or your internet connectivity.
9. Intellectual Property
The Service, including its design, code, features, logos, and documentation, is owned by BotInbox and is protected by intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works of any part of the Service without our prior written consent.
10. Limitation of Liability
To the maximum extent permitted by applicable law, BotInbox shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses arising out of or related to your use of the Service. Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited by law.
11. Indemnification
You agree to indemnify and hold harmless BotInbox, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
- You may terminate your account at any time through your account settings or by contacting support.
- We may suspend or terminate your account if you violate these Terms, with notice where practicable.
- Upon termination, your right to use the Service ceases immediately.
- You may export your data before termination. After termination, we will retain your data for 30 days to allow recovery, after which it will be permanently deleted.
- Sections on Limitation of Liability, Indemnification, and Governing Law survive termination.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.
If you are a consumer in the EU/EEA, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence, and you may bring proceedings in the courts of that country.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes at least 30 days in advance via email or through the Service. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you may terminate your account.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
